TERMS OF SERVICE

§1 Scope, customer information

The following terms and conditions (GTC) govern the contractual relationship between individual companies Ralf Sempert and the consumers and entrepreneurs who buy through our shop Wehrmacht1945.de goods. Conflicting or deviating from our terms and conditions are not recognized by us. The contract language is German.

 

§ 2 Conclusion of contract

(1) The offers on the Internet constitute a binding offer to you to buy goods.

(2) You can add one or more products to the shopping cart. In the course of the ordering process you enter your data and wishes regarding payment method, delivery modalities etc. Only by clicking on the order button "Buy" you accept the offer to conclude a purchase contract.

 

§ 3 Customer information:

Storage of the contract text

Your order with details of the contract (for example, type of product, price, etc.) will be stored by us. We will send you the terms and conditions, but you can also access the terms and conditions after conclusion of the contract at any time via our website. As a registered customer, you can access your past orders through the Customer LogIn section (Orders).

 

§ 4 Customer Information:Correction

Notice You can correct your entries at any time before placing the order with the delete key. We will inform you on the way through the ordering process about further correction options. You can also end the ordering process at any time by closing the browser window


§ 5 Retention of title

The purchase remains our property until full payment.

 

§ 6 Statutory warranty rights and statute of limitations

(1) Liability for defects

There are statutory warranty rights for our goods.

(2) Restriction of the warranty for defects (warranty) against consumers of second-hand goods

There are two deadlines for your claims for defects, both of which run from the delivery of used goods to you. We reduce the period of liability for defects from two years to one year. Defects occurring within this period of liability, however, can be asserted until the expiry of the statutory limitation period of two years. Excluded from the shortening of the period of liability are claims for damages, claims for defects that we have fraudulently concealed, and claims from a warranty that we may have assumed for the condition of the goods. For these excluded claims, the statutory periods apply. If there is a guarantee period, the longer period will apply to the guarantee holder.

(3) Guarantee to entrepreneurs

- for damages

- for maliciously concealed defects

- from any given warranty

- on recourse to §§ 445a, 478 BGB

- because of defects in building materials and components that have been used in accordance with their normal use for a building and have caused its defectiveness.

For these excluded claims, the statutory limitation periods apply. In the case of a possibly granted warranty period, the longer period applies to the benefit of the buyer.

 

§ 7 Limitation of Liability

We exclude liability for slightly negligent breaches of duty, insofar as these do not concern essential contractual obligations, damages resulting from injury to life, body or health, guarantees or claims under the Product Liability Act (ProdHaftG). The same applies to breaches of duty by our vicarious agents and our legal representatives. One of the essential contractual obligations is in particular the obligation to hand over the matter to you and to give you the ownership of it. Furthermore, we have to procure the matter free of material and legal defects.

 

§ 8 Dispute resolution

Alternative Dispute Resolution: The European Commission provides a platform for out-of-court online dispute resolution (OS platform), available at https://ec.europa.eu/odr (https://ec.europa.eu/odr).
"We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board."

 

§ 9 Notes on battery disposal

Since batteries and batteries may be included in our deliveries, we are obliged under the Battery Act (BattG) to point out the following: Batteries and rechargeable batteries must not be disposed of as domestic waste, but you are legally obliged to return used batteries and rechargeable batteries. Used batteries may contain harmful substances which, if not properly stored or disposed of, could damage your health or the environment. But batteries also contain important raw materials and can be recycled. You can either return the batteries to us after use or return them in the immediate vicinity (for example, in stores or in our dispatch warehouse ( Christian Sempert, Carl-Struck-Str. 15, 17192 Waren Müritz ).


§ 10 proof of age

All items marked "+18" in the text (for example: knives, bayonets, etc.) may only be handed over to persons over the age of 18 years. The buyer must identify himself directly after the order with a proof of age +18, so that the order can be processed. The proof of age must be provided in the form of a copy of an official document (eg identity card.) By e-mail to info@wehrmacht1945.de and confirm them with your legally binding signature.
